These terms govern your use of capecodmanagement.com and the vacation rental management services provided by Management On The Cape.

1. Acceptance of Terms
By accessing capecodmanagement.com (the "Site") or engaging Management On The Cape ("we," "us," or "our") for property management services, you ("you," "Owner," or "Guest," as applicable) agree to be bound by these Terms and Conditions. If you do not agree, please discontinue use of the Site and our services.
2. About Management On The Cape
Management On The Cape is a Cape Cod-based short-term and vacation rental management company specializing in single-family properties across Cape Cod, Massachusetts, including Bourne, Falmouth, Harwich, and Provincetown. Our principal place of business is:

3. Scope of Services
Subject to a written management agreement between Management On The Cape and the Property Owner, our services may include:
- One-to-one curated management strategy for vacation rental properties
- Listing, marketing, pricing, and reservation management
- 24/7 local on-call support for guest inquiries
- Routine and turnover housekeeping coordination
- Pre-arrival 50-point property inspections
- Coordination of minor maintenance work, complimentary as described in your management agreement
- Owner reporting and revenue distribution
The full scope, exclusions, term, and any commissions or fees applicable to a specific property are set forth in the executed management agreement, which controls in the event of any conflict with these Terms.
4. Property Owner Responsibilities
Property Owners agree to:
- Maintain a property that is safe, clean, and in good working condition prior to onboarding
- Carry adequate property and liability insurance, including short-term rental coverage where required
- Comply with all applicable Cape Cod town ordinances, Massachusetts state law, and federal regulations, including registration, occupancy, and short-term rental excise tax requirements
- Provide accurate property information, working keys/access, and timely approval for repairs above any agreed threshold
- Promptly remit any reimbursable expenses or balances owed to Management On The Cape
5. Guest & Booking Terms
Guests booking a property managed by Management On The Cape do so subject to the rental agreement, house rules, and platform terms (e.g., Airbnb, Vrbo, or direct booking) that apply to that reservation. Without limitation, Guests agree:
- To comply with stated occupancy limits, quiet hours, parking limits, and pet policies
- That smoking is prohibited at all properties unless expressly permitted in writing
- That events, parties, and commercial use are prohibited unless expressly approved in writing
- To be financially responsible for damage caused beyond ordinary wear and tear
- That Management On The Cape may inspect the property in the event of a reasonable concern about safety, damage, or rule violations
6. Fees, Payments & Maintenance
Management commissions, payment schedules, and reimbursable expenses are governed by the Owner's management agreement. As described on our Site, all minor maintenance work coordinated by Management On The Cape is provided at 100% complimentary labor under the standard management agreement; third-party parts, materials, vendor invoices, capital repairs, and any work outside the scope of "minor maintenance" remain the responsibility of the Property Owner.
Guest payments, deposits, taxes, and refunds are processed in accordance with the applicable booking platform or rental agreement.
7. Owner Use of Property
As described on our Site, Property Owners enjoy unlimited owner use of their property with no blackout dates, subject only to existing confirmed guest reservations and reasonable advance notice so that housekeeping and turnover can be scheduled.
8. Inspections & Standards
Every guest arrival is preceded by our 50-point inspection. While we take reasonable steps to identify and resolve issues prior to check-in, Management On The Cape does not warrant that every condition or item will be defect-free, and does not guarantee any specific occupancy, revenue, or guest review outcome.
9. Liability & Insurance
To the fullest extent permitted by law, Management On The Cape is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost rental income, arising out of or related to the Site or our services. Our aggregate liability for any claim shall not exceed the management fees paid by the Owner to Management On The Cape during the three (3) months preceding the event giving rise to the claim, unless a different limit is set forth in the management agreement.
Property Owners are required to maintain their own property and liability insurance. Management On The Cape's coverage does not replace or substitute for an Owner's insurance.
10. Website Use & Intellectual Property
All content on the Site — including text, photographs, the Management On The Cape name, logo, and brand elements — is owned by or licensed to Management On The Cape and protected by U.S. copyright and trademark law. You may view and share the Site for personal, non-commercial purposes; you may not copy, reproduce, scrape, or use our content for commercial purposes without prior written consent.
You agree not to use the Site to (a) violate any law, (b) attempt to gain unauthorized access to any system, (c) introduce malicious code, or (d) interfere with the Site's operation.
11. Privacy
Information you submit through the Site or share with us by phone or email — such as your name, contact details, and property information — is used solely to respond to your inquiry, deliver our services, and communicate with you about your property. We do not sell personal information.
12. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site or our services after changes are posted constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or our services shall be brought exclusively in the state or federal courts located in Barnstable County, Massachusetts, and you consent to personal jurisdiction and venue there.
